Please read these terms and conditions carefully before using our services.
Service Provider: PeakCampNepal | Treks & Travels in Nepal
These Terms & Conditions govern all trekking, tour, expedition, climbing, cultural, and adventure travel services provided by PeakCampNepal to the Client. By booking any trip with PeakCampNepal, the Traveler agrees to the following legally binding conditions in accordance with the tourism laws, regulations, and industry practices of Nepal, including the provisions under the Nepal Tourism Act, Company Act of Nepal, Department of Tourism regulations, Nepal Tourism Board guidelines, Trekking Agencies’ Association of Nepal (TAAN) practices, and applicable civil laws of Nepal.
1. Booking Confirmation & Contract
A booking shall be considered confirmed only after:
- Submission of the completed booking form/passport copy
- Acceptance by the Company in writing/email
- Receipt of the required advance deposit
The person making the booking confirms that all travelers listed in the booking accept these Terms & Conditions. The contract between the Traveler and PeakCampNepal becomes effective upon written confirmation by the Company.
2. Deposit, Payment & Refund Policy
- A deposit of 20%–30% of the total trip cost is required to confirm the booking.
- The remaining balance must be paid before trip departure unless otherwise agreed by the Company.
- Payments may be made via bank transfer, online payment gateway, or cash in accepted currencies.
- Bank charges, card fees, and currency conversion fees shall be borne by the Traveler.
- Failure to complete payment on time may result in cancellation of the booking.
Refund Policy
- Booking deposits are generally non-refundable due to advance operational and administrative costs.
- Cancellation requests must be submitted in writing.
Refund structure:
- More than 30 days before departure: Refund available excluding deposit and non-refundable expenses.
- 15–30 days before departure: Up to 50% refund.
- Less than 15 days before departure: No refund.
No refund shall apply for:
- Unused services after trip commencement
- Voluntary withdrawal or early return
- Missed flights
- Delays or cancellations caused by weather, natural disasters, political unrest, strikes, pandemics, or other force majeure events
- Domestic flights and helicopter services are subject to the policies of the respective service providers
- Approved refunds shall be processed within 15–30 working days.
- The Company may offer trip postponement, transfer, or travel credit instead of monetary refund where applicable.
3. Cancellation by the Traveler
Cancellation requests must be submitted in writing by email or official message.
Refund policy:
- More than 30 days before departure: refundable excluding deposit and administrative charges.
- 15–30 days before departure: up to 50% refund.
- Less than 15 days before departure: no refund.
No refund shall be provided for:
- Unused services
- Early return
- Missed flights
- Voluntary withdrawal from the trip
- Delays caused by weather, illness, strikes, political events, or force majeure
The Company may, at its discretion, allow postponement or trip transfer to another date or participant.
4. Cancellation or Modification by the Company
PeakCampNepal reserves the right to modify itineraries, accommodations, transportation, guides, or trip schedules due to:
- Weather conditions
- Flight cancellations
- Natural disasters
- Government restrictions
- Health emergencies
- Political unrest
- Safety concerns
- Any event beyond reasonable control
If the Company cancels the trip before departure for reasons within its control, the Traveler shall receive a refund for the unused portion of the trip. Additional compensation shall not apply.
5. Travel Insurance (Mandatory)
All Travelers must obtain comprehensive travel insurance before arrival in Nepal covering:
- High-altitude trekking
- Helicopter evacuation
- Medical expenses
- Accidental injury
- Emergency rescue
- Trip cancellation
- Repatriation
- Loss or theft of baggage and equipment
The Traveler must carry proof of insurance during the trek. Any rescue, evacuation, or medical expenses not covered by insurance shall remain the sole responsibility of the Traveler.
6. Health, Fitness & Medical Disclosure
The Traveler confirms being physically and mentally fit for trekking and adventure activities in Nepal.
The Traveler must disclose:
- Existing medical conditions
- Allergies
- Medication use
- Physical limitations
- Recent surgeries or illnesses
PeakCampNepal reserves the right to deny participation if a Traveler’s condition poses a safety risk to themselves, staff, or group members.
7. Trekking Risks & Assumption of Responsibility
The Traveler understands that trekking, climbing, and adventure travel in Nepal involve inherent risks including but not limited to:
- Altitude sickness
- Avalanches
- Rockfall
- Floods
- Landslides
- Glacier hazards
- Extreme weather
- Wildlife encounters
- Transportation accidents
- Remote medical limitations
The Traveler voluntarily accepts these risks and agrees to follow all safety instructions issued by guides and staff during the trip.
8. Permits, Passport, Visa & Legal Compliance
The Traveler is responsible for:
- Carrying a valid passport
- Obtaining a Nepal visa
- Providing accurate documents
- Complying with Nepal immigration and trekking regulations
PeakCampNepal shall assist in arranging trekking permits and national park/conservation fees where included in the package. Restricted areas of Nepal may legally require licensed guides, special permits, and group travel arrangements as per Department of Tourism regulations.
9. Guide Authority & Traveler Conduct
For safety reasons:
- Decisions made by the trekking guide or expedition leader shall be final during the trip.
- The Company reserves the right to remove any Traveler whose behavior is unlawful, abusive, unsafe, intoxicated, environmentally harmful, or disruptive to local communities or group operations.
- No refund shall be issued in such circumstances.
The Traveler agrees to respect:
- Nepalese laws
- Local customs
- Religious sites
- Environmental conservation rules
- Mountain ethics and Leave No Trace principles
10. Environmental & Cultural Responsibility
PeakCampNepal promotes sustainable tourism and responsible trekking practices. Travelers agree:
- Not to litter or damage natural heritage
- To minimize plastic waste
- To respect local traditions and sacred places
- Not to engage in illegal wildlife trade or prohibited activities
- To follow conservation area and national park regulations of Nepal
11. Liability Limitation
PeakCampNepal acts as an organizer and intermediary for hotels, airlines, transportation providers, guides, and other service providers. The Company shall not be liable for:
- Injury, death, loss, delay, theft, or damage caused by events beyond its reasonable control
- Flight disruptions
- Weather conditions
- Government actions
- Pandemics
- Strikes
- Force majeure events
- Actions or negligence of third-party providers
The Company’s maximum liability shall not exceed the total trip amount paid by the Traveler unless otherwise required under Nepal law.
12. Governing Law & Dispute Resolution
These Terms & Conditions shall be governed by the laws of Nepal. Any dispute arising from booking or travel services shall first be attempted to be resolved through mutual negotiation. If unresolved, disputes shall fall under the jurisdiction of the courts of Kathmandu, Nepal. PeakCampNepal reserves the right to update these Terms & Conditions at any time without prior notice.
